Terms and conditions
Article 1 : designation of the seller
This Mamazarbia.fr site is published by the limited liability company MERYS B. & ADIL BO COMPANY with capital of 1,000 euros, whose head office is located at 2 Place Martin Levasseur 93400 Saint-Ouen-sur-Seine, registered with the RCS of Bobigny under number XXX and at the RNE under number xxx.
Article 2: general provisions relating to these general conditions of sale (hereinafter the General Conditions of Sale)
Purpose of the General Terms and Conditions
The General Terms and Conditions apply exclusively to the online sale of products from MERYS B. & ADIL BO COMPANY (hereinafter seller) on the Mamazarbia.fr site (hereinafter the site), access to which is open to all.
Scope of application of the General Conditions of Sale
The General Terms and Conditions exclusively govern contracts for the online sale of products from the professional seller to buyers having the status of consumers (hereinafter consumers) and constitute, with the online order, the contractual documents enforceable against the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products which have only indicative value.
Availability and opposability of the General Conditions of Sale
The General Terms and Conditions are made directly available to consumers on the seller's website. They are enforceable against the consumer who acknowledges, by checking a box provided for this purpose, having been aware of them and having accepted them before placing an order.
Modification of the T&Cs
These T&Cs were updated on May 1, 2024. The professional seller reserves the right to modify its T&Cs at any time. In the event of modification of the General Conditions of Sale, the applicable General Conditions of Sale are those in force on the date of the order, a copy of which dated to date can be given to the consumer upon request.
Clauses of the General Conditions of Sale
The nullity of a contractual clause does not result in the nullity of the General Terms and Conditions. The temporary or permanent non-application of one or more clauses of the T&Cs by the professional seller cannot constitute a waiver on his part of the other clauses of the T&Cs which continue to have their effects.
Article 3: products
Features
The products offered for sale presented in the catalog published on the site are each the subject of a description mentioning their essential characteristics within the meaning of article L. 111-1 of the Consumer Code. The photographs illustrating the products do not constitute a contractual document.
Use of products
The site offers decoration products for sale to individuals and professionals.
Compliance
The products comply with the regulations in force relating to the safety and health of people, the fairness of commercial transactions and the protection of consumers at the time of their placing on the market. The products comply with the requirements of French law in force at the time of their placing on the market.
Stock availability
The products are offered and delivered while stocks last. In the event of unavailability of the ordered product, the seller immediately informs the buyer and may offer him a product of equivalent quality and price or, failing that, a voucher for the amount of the order that can be used for any next order. In the event of disagreement by the buyer, the seller will reimburse the sums paid within 5 working days.
Article 4: price
Selling price
The sales prices, in accordance with article L. 112-1 of the Consumer Code, are indicated, for each of the products appearing in the electronic catalog, in euros all taxes included, excluding delivery and transport costs mentioned before validation of the order and charged extra. The total amount owed by the consumer is indicated on the order confirmation page. The selling price of the product is that in effect on the day of the order.
Edit
The professional seller reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in force on the day of the order.
Costs
Additional transport, delivery or postage costs, of which the customer was aware before ordering, are set out on the order form.
Article 5: offer
Domain
The online sales offers presented on the site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries to these same areas.
Duration
The online sales offers presented on the site are valid, in the absence of indication of a particular duration, as long as the products appear in the electronic catalog and while stocks last.
Acceptance
Acceptance of the offer by the consumer is validated, in accordance with the double click process, by confirmation of the order.
Article 6: order
Stages of concluding the contract
To place an order, the consumer, after having filled his virtual basket by indicating the selected products and the desired quantities, then clicks on the “Order” button and provides information relating to delivery and payment method. Before clicking on the “Confirm order” button, the consumer has the possibility to check the details of his order and its total price and to return to previous pages to correct any errors or possibly modify his order. Confirmation of the order entails acceptance of the General Terms and Conditions and forms the contract. An email acknowledging receipt of the order and its payment is sent by the seller as soon as possible.
Order modification
Any order modification by the consumer after confirmation of his order is subject to acceptance by the professional seller. The professional seller reserves the right to make modifications to the product ordered which are linked to technical developments under the conditions provided for in Article R. 212-4 of the Consumer Code.
Confirmation of the order
The professional seller reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of products ordered are abnormally high for buyers who are consumers.
Article 7: contract
Conclusion
The sales contract is formed when the consumer sends the confirmation of his order.
Archiving and proof
The archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with article 1360 of the civil code. These communications, purchase orders and invoices may be produced as proof of the contract.
Article 8: payment
Payability
The price is due in full after confirmation of the order. Payment is made immediately upon ordering by credit card.
Payment security
The site is equipped with an online payment security system allowing the consumer to encrypt the transmission of their banking data.
Article 9: delivery
Definition
Delivery means the transfer to the consumer of physical possession of the good.

From the delivery date indicated in the order form, ownership of the product is transferred to the buyer, except in the case where full payment of the price has not been collected when ordering.
Article 10: return of Products and right of withdrawal
The consumer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request an exchange or refund with the exception of return costs which remain his responsibility. The right of withdrawal can be exercised through our customer service directly from our website in the “Contact us” section. We will immediately send you an acknowledgment of receipt of the withdrawal on a durable medium (for example, by email). Returns must be made in their original and complete condition allowing them to be remarketed in new condition. Any product opened or damaged by the consumer will not be taken back. In the event of withdrawal, the seller will reimburse all payments received either by re-crediting the consumer's bank card or Paypal account, or by bank transfer depending on the method of payment for the order. The seller may defer reimbursement until receipt and verification of the products.
Article 11: processing of personal data

Article 12: dispute resolution
The seller cannot be held responsible for damage resulting from improper use of its products. In the event of a dispute, you must first contact the company's customer service department by email at hello@mamazarbia.com in order to attempt to resolve the dispute informally.
Article 13: applicable law
This contract and the T&Cs governing it are subject to French law.
